General terms and conditions of business

1. Scope
These General Terms and Conditions apply to all services provided by Corina Rhodovi, Emser Str. 88, 12051 Berlin (hereinafter: Provider). By booking a service, the customer accepts the following Terms and Conditions.
2. Registration and Conclusion of Contract

Customers have the option to book individual sessions as well as pricing plans (“credits”) via the website.

The purchase of a pricing plan entitles the customer to book individual sessions in the course and time period included in the pricing plan. The number of individual sessions depends on the respective pricing plan.

Pricing plans are tied to the respective course and expire at the end of the course.
3. Right of Use

By purchasing a pricing plan, the customer is entitled to book individual sessions within the course included in the pricing plan.

By booking a session, the customer is entitled to participate in the booked session.

If the customer is unable to attend, they may nominate another person to participate in the session as a substitute. Rebooking or a name change is not required.

Non-use of sessions for reasons that do not justify extraordinary termination does not entitle the customer to a reduction or refund of their payment. A credit for unused sessions is not possible.
4. Payment Terms

When purchasing a pricing plan, the customer may choose to pay via credit/debit card, Apple Pay, or Google Pay through Wix Payments. The respective amount is due within 14 days after purchase.

Individual sessions and trial classes may also be booked and paid for on-site. The amount is due on the day of the session.
5. Termination for Good Cause

Without limiting the rights granted elsewhere in these Terms and Conditions, both the provider and the customer have the statutory right to terminate services at any time for good cause.
6. Rescheduling and Cancellation
-
The right of withdrawal does not apply to sessions, courses, workshops, and 1:1 sessions pursuant to § 312g para. 2 no. 9 BGB, as these events take place at a specific time or within a specific period. Advance payments will not be refunded.

Sessions may be rescheduled free of charge up to 24 hours before the session.

If sessions are cancelled within the customer account within the cancellation period, a credit (“Credit”) will be issued which can be used to book a new session.

If the cancellation occurs less than 24 hours before the session, 100% of the session price will be charged, including in cases of illness even if a medical certificate is presented.
7. Cancellation by the Provider

The provider is entitled to withdraw from the contract for good cause, particularly in the case of insufficient participant numbers, illness, or other reasons beyond the provider’s control that make the course impossible to conduct.

Participation fees already paid will be fully refunded.

Participants are not entitled to compensation or claims for damages.

In the event of illness, vacation, or other inability of the provider to conduct the session, or in circumstances such as force majeure, sessions may be held online, cancelled, or rescheduled by the provider.
8. Liability

Participation in services is at the participant’s own risk. The provider is not liable for accidents or resulting physical injuries suffered by customers.

The provider’s liability for financial and property damage is limited to intent and gross negligence, unless damages were caused by the provider’s breach of essential contractual obligations.
9. Health Condition

By booking a course or session, the participant confirms that they are physically healthy, mentally stable, and capable of meeting the relevant physical and mental requirements, and that they will only participate in the course in such a condition.

Participation in yoga classes under the influence of drugs, alcohol, or medication is not permitted.

The services offered are not to be understood as therapy or a medical treatment program. They do not replace medical care or the prescription of medication in any way.

By participating, the customer confirms that they do not suffer from any contagious disease and that there are no medical reasons preventing them from performing the yoga exercises. In case of doubt, a doctor should be consulted.

Pregnancy, injuries to the spine and joints, heart conditions, or other illnesses or physical impairments must be disclosed before the start of the course in the participant’s own interest.
Cancellation policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us, Frequency Yoga, owner Corina Rhodovi, Emser Str. 88, 12051 Berlin, Email: corina{at}frequency-yoga.de, by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You may use the model withdrawal form provided by the consumer advice center, but this is not obligatory.
To meet the cancellation deadline, it is sufficient that you send the notification of exercising your right of cancellation before the cancellation period expires.
The right of withdrawal does not apply to sessions, courses, workshops, and 1:1 sessions in accordance with Section 312g Paragraph 2 No. 9 of the German Civil Code (BGB), as these events take place at a specific time or within a specific period. Advance payments are non-refundable.
Consequences of the revocation
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement.
